By downloading, installing, or using Infinite Flight Simulator ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not download, install, or use the App.
We reserve the right to modify these Terms at any time. You are responsible for reviewing and becoming familiar with any modifications. Your continued use of the App following any changes constitutes your acceptance of those changes.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. You may not:
Some features of the App may require you to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols) with your account.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
The App may offer opportunities to purchase virtual goods, features, or content ("In-App Purchases"). All In-App Purchases are final and non-refundable except as required by applicable law.
You acknowledge that:
The App may allow you to create, upload, post, send, receive, and store content such as flight paths, screenshots, or other materials ("User Content"). You retain all rights in, and are solely responsible for, the User Content you create, upload, post, send, or store through the App.
By creating, uploading, posting, sending, receiving, or storing User Content through the App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, use, display, reproduce, modify, adapt, edit, publish, and distribute that User Content for the purpose of operating, developing, providing, promoting, and improving the App.
You agree not to engage in any of the following prohibited activities:
The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by us, our licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
These Terms permit you to use the App for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App.
We may terminate or suspend your access to all or part of the App, without notice, for any conduct that we, in our sole discretion, believe is in violation of any applicable law or is harmful to the interests of another user, a third-party, or us.
Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App or delete it from your device.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER WE NOR ANY PERSON ASSOCIATED WITH US MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE APP.
THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
IN NO EVENT WILL WE, OUR AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE APP, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
You agree to defend, indemnify, and hold harmless us, our affiliates, licensors, and service providers, and our and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which our principal place of business is located, without giving effect to any choice or conflict of law provision or rule.
Any legal action or proceeding relating to your access to, or use of, the App or these Terms shall be instituted in the courts located in the jurisdiction in which our principal place of business is located. You and we agree to submit to the personal jurisdiction of, and venue in, such courts.
No waiver by us of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of us to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
These Terms constitute the sole and entire agreement between you and us regarding the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the App.
